Notice of the Right of Withdrawal

This notice applies to you if you are a consumer (Verbraucher) within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG) and you conclude a distance contract or an off-premises contract within the meaning of the Austrian Distance Selling and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz, FAGG). It applies to the services offered by the provider, in particular one-to-one mentoring, the online courses and the newsletter. For business customers (Unternehmer), the statutory right of withdrawal does not apply.

1. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (purebeing.eu — PURE BEING by Shalini Mehra, Dipl.-Päd. Shalini Mehra, Florianiweg 7, 6212 Maurach am Achensee, Austria, e-mail: connect@purebeing.eu) of your decision to withdraw from this contract by means of an unequivocal statement (for example, a letter sent by post or an e-mail). You may use the attached model withdrawal form for this purpose, but it is not mandatory. To meet the withdrawal deadline, it is sufficient that you send your notification concerning the exercise of your right of withdrawal before the withdrawal period has expired.

2. Consequences of withdrawal

If you withdraw from this contract, we shall reimburse all payments we have received from you without undue delay and, in any event, no later than fourteen days from the day on which we received the notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement.

If you requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you notify us of the exercise of your right of withdrawal in respect of this contract, compared with the total scope of the services provided for in the contract.

3. Special notes on the expiry of the right of withdrawal

For contracts for the supply of digital content not supplied on a physical medium, your right of withdrawal expires if we have begun performance of the contract after you expressly consented to our beginning performance of the contract before the expiry of the withdrawal period, and you confirmed your knowledge that you thereby lose your right of withdrawal once performance of the contract begins.

For contracts for services, your right of withdrawal expires if we have provided the service in full and performance has begun only after you expressly consented to our beginning performance before the expiry of the withdrawal period, and you confirmed your knowledge that you thereby lose your right of withdrawal once performance begins.

In the cases described above, your right of withdrawal expires only if BOTH requirements are met: your express consent to the early beginning of performance AND your confirmation that you are aware that you thereby lose your right of withdrawal. If even one of these two requirements is missing, your right of withdrawal does not expire.

5. Scope of application and cancellation of individual appointments

The rights set out in this notice are mandatory statutory rights of consumers; they remain unaffected by the provider's contractual terms and are not restricted by them. For business customers (Unternehmer), the statutory right of withdrawal does not apply.

The cancellation of individually booked appointments (for example, one-to-one consultations and one-to-one mentoring sessions) is governed by the cancellation terms set out in the provider's Terms and Conditions: cancellations more than 48 hours before the agreed appointment are free of charge; for cancellations between 48 and 24 hours before the appointment, 50 % of the agreed fee is charged; for cancellations less than 24 hours before the appointment or in the event of a no-show, 100 % of the agreed fee is charged. These cancellation terms apply independently of the statutory right of withdrawal and do not restrict it.
